1. Introduction
Welcome to the Student Development Platform (SDP) !
These Terms of Service contained herein (“Terms”) govern your use of the SDP platform located at https://icode4nus.sg/ (“Service”) operated by National University of Singapore (NUS).
The Privacy Policy found at ¶18 shall also govern your use of the Service. It explains how we collect and disclose information that results from your use of the Service.
Your use of the Service shall be taken as an acknowledgement that you have read and understood the Terms and our Privacy Policy, and your agreement to be bound by the Terms and the Privacy Policy.
Any use of the Service is subject to the Terms and the Privacy Policy. If you do not agree (or cannot comply) with these Terms and the Privacy Policy, then you may not use the Service. Please do contact us at sdp@nussucomit.com for any concerns/queries.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "You", "Your", “User” refers to the end-user, who shall be subject to the Terms and Privacy Policy. . "SDP”" and “Service” refers to SDP. "Parties" refers to both you and ourselves. “Terms” and “Terms of Service” includes, but is not limited to, the terms and policies contained herein. SDP refers to SDP, any agent of SDP, or any person authorized to act on behalf of SDP.
2. Content
Content found on, or through, this Service is the property of NUS, or otherwise used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express written permission from SDP, which must be requested in advance.
3. Prohibited Uses
You may use the Service only for lawful purposes and in accordance with the Terms contained herein. You agree not to use the Service:
3.1.1. In any way that violates any applicable national, or international, laws and regulations.
3.1.2. For the purposes of exploiting, harming, or attempting to exploit or harm minors in any way, whether by exposing them to inappropriate content or otherwise.
3.1.3. To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter,” “spam,” or any other similar solicitation.
3.1.4. To impersonate or attempt to impersonate SDP, an agent of SDP, another user, or any other person or entity.3.1.5. In any way that infringes upon the rights of others
3.1.6. In any way that is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
3.1.7. To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Service, or which (as determined by SDP) may harm or offend SDP, NUS ,or the other users of Service, or expose them to liability.
Additionally, you agree not to:
3.2.1 Use Service in any manner that could disable, overload, damage, or impair the Service or unreasonably interfere with any other party’s use of Service, including their ability to engage in real time activities through the Service.
3.2.2 Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service.
3.2.3. Use any manual process to monitor or copy any of the material on the Service for any unauthorized purpose.
3.2.4. Use any device, software, or routine that interferes with the proper working of the Service.
3.2.5. Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
3.2.6. Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
3.2.7. Attack the Service via a denial-of-service attack or a distributed denial-of-service attack.
4. Analytics
SDP may use third-party Service Providers to monitor and analyze the use of the Service.
5. No Use By Minors
The Service is intended only for access and use by individuals at least eighteen (18) years of age. By accessing or using Service, you warrant and represent that you are at least eighteen (18) years of age, and possess the full authority, right, and capacity to enter into this agreement and abide by all Terms contained herein. If you are not at least eighteen (18) years old, you are prohibited from accessing and/or using the Service.
6. Trademark
The users shall not use our trademarks in connection with any product or service without the prior written consent of NUS.
7. Intellectual Property
The Service and its original content, features, functionality including the all solutions, or any part thereof, developed by users on SDP are, and shall, remain the exclusive property of NUS and its licensors. The ownership of solutions created by users belongs to NUS even after the users decide to terminate their project on SDP.
8. Copyright Policy
SDP respects the intellectual property rights of others. It is our policy to investigate any claim that Content posted on the Service infringes on the copyright or other intellectual property rights of any person or entity.
If you are a copyright owner, or authorized on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to sdp@nussucommit.com, with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged infringement.
Note, you may be held accountable for damages (including costs and attorneys’ fees) for misrepresentation or bad faith claims regarding the infringement of your copyright by any Content on the Service.
9. Procedure for Copyright Infringement Claims
You may submit a notification by providing our Copyright Agent with the following information in writing.
8.1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright’s interest;
8.2. a description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work;
8.3. identification of the URL or other specific location on Service where the material that you claim is infringing is located;
8.4. your address, telephone number, and email address;
8.5. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
8.6. a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

10. Error Reporting and Feedback
You may provide us either directly at sdp@nussucommit.com with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to the Service (“Feedback”). You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) the SDP may have development ideas similar to the Feedback; (iii) the Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) the SDPis not under any obligation of confidentiality with respect to the Feedback.
11. Links to Other Websites
The Service may contain links to third-party web sites or services that are not owned or controlled by NUS. Neither NUS nor SDP has any control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. We do not in any way warrant the offerings of any of these entities/individuals or their websites.
You acknowledge and agree that SDP and NUS shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third-party web sites or services.
We strongly advise you to read the terms of service and privacy policies of any third-party web sites or services that you visit.
12. Disclaimer of warranty
The Service is provided by SDP on an “as is” and “as available” basis. SDP makes no representations or warranties of any kind, express or implied, as to the operation of their services, or the information, content or materials included therein. Your use of these services and their content is at your sole risk.
Neither SDP, nor NUS, nor any person associated with the SDP or NUS, is making any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the services. Without limiting the foregoing, neither SDP or NUS, nor anyone associated with SDP or NUS, represents or warrants that the services, their content, or any services or items obtained through the services will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, that the services or the server that makes it available are free of viruses or other harmful components or that the services or any services or items obtained through the services will otherwise meet your needs or expectations.
13. Limitation of liability
Except as prohibited by law, you will hold SDP and SDP’s officers, directors, employees, and agents harmless for any indirect, punitive, special, incidental, or consequential damage, however it arises (including legal’ fees and all related costs and expenses of litigation and arbitration, or at trial or on appeal, if any, whether or not litigation or arbitration is instituted), whether in an action of contract, negligence, or other tortious action, or arising out of or in connection with this agreement, including without limitation any claim for personal injury or property damage, arising from this agreement and any violation by you of any laws, statutes, rules, or regulations, even if SDP has been previously advised of the possibility of such damage. Except as prohibited by law, if there is liability found on the part of the SDP, it will be limited to the value of the products and/or services. Under no circumstances will there be consequential or punitive damages.
By reserving the right to change or delete anything on your site, as well as stating that you may encounter hardware problems and downtime, you limit your liability if users claim any loss or damage because of an inability to access your site.
SDP reserves the right to modify and/or remove any Content on the Service at any time and/or for any reason, at SDP’s sole discretion without notice. SDP also reserves the right to modify or discontinue all or part of the Service without notice at any time. SDP will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service. SDP cannot guarantee the Service will be available at all times. SDP may experience hardware, software, other problems or need to perform maintenance related to the Service, resulting in interruptions, delays, or errors. SDP reserves the right to change, revise, update, suspend, discontinue, or otherwise modify the Service at any time or for any reason without notice to you. You agree that SDP has no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Service during any downtime or discontinuance of the Service. Nothing in these Terms shall be construed to oblige SDP to maintain and support the Service or to supply any corrections, updates, or releases in connection therewith.
14. Termination
SDP reserves the right to terminate or suspend your account and bar access to Service immediately, without prior notice or liability, under SDP’s sole discretion, for any reason whatsoever and without limitation (including, but not limited to, a breach of Terms).
If you wish to terminate your account, you may refer to the procedure on the Removal of Applications from SDP under SDP’s Guidelines.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. The Parties hereto hereby agree to resolve all and any issues through third-party mediation.
SDP’s forbearance in enforcing any right or provision of these Terms shall not be considered a waiver of those rights.
These Terms contained herein constitute the entire agreement between SDP and the end-user regarding our Service, and supersede and replace all and any prior agreements, oral or written, between SDP and the end-user.
16. Changes To Service
SDP reserves the right to withdraw or amend the Service, and any service or material provided via the Service, at SDP’s sole discretion without notice. SDP will not be liable if, for any reason, all or any part of the Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Service, or the entire Service, to certain groups of users, including registered users.
17. Amendments to Terms
We may amend Terms at any time by posting the amended terms on this site. SDP shall expend reasonable effort to alert existing users to the amendment in Terms. .By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised terms.
18. Waiver and Severability
No waiver by SDP of any term or condition set forth in the Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of SDP to assert a right or provision under the Terms shall not constitute a waiver of such right or provision.
If any provision of Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of Terms will continue in full force and effect.
19. Privacy Policy
The purpose of personal data collection by SDP is for SDP to identify the developers who will be working on the projects. The collection of personal contact information is for ease of communication with Users on SDP for the purpose of progress monitoring on the projects or to aid in any administrative matters.
All collection, use, and disclosure of personal data of the users by NUSSU, SDP, or NUS IT shall adhere to Section 13 of the Personal Data Protection Act ("PDPA"), and the NUS Personal Data Notice for Students. Any personal data collected will be used for purposes related to the Platform. NUS IT may also use the contact information of users to contact them about NUS IT initiatives and programmes.
20. Acknowledgement
BY USING THE SERVICE PROVIDED BY SDP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
